Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

We regularly review this privacy policy. Occasionally, we may need to make changes or updates to this privacy policy that may affect how we handle your data. We will post new versions of this privacy policy on our website www.jetbeds.com, particularly on our privacy page https://www.jetbeds.com/en_de/links/datasecurity. We may also notify you by email of changes to this privacy policy.

This privacy policy was last reviewed and updated on August 19, 2024.

WHAT PERSONAL DATA WE COLLECT, MAY COLLECT, AND HOW WE COLLECT IT

We collect personal data from you when you register on our website and/or make a booking. This includes at least your email address, and may also include your name, phone number, mailing address, and date of birth.

We use this information to: (i) Provide your free jetbeds user account
(ii) Keep you informed about our current travel offers

We primarily transmit data for the purpose of processing your bookings. A fundamental part of the service jetbeds provides to its users is the regular sending of email newsletters with our latest travel offers tailored to your personal preferences. You may object to the storage of your personal data at any time. Please send an email to privacy@asw.com with the subject "Remove Data Records".

The processing and use of your personal data is carried out in accordance with the provisions of the GDPR.

COOKIES

The data controller uses so-called "cookies" to personalize and optimize the online experience and online time of the customer. A cookie is a text file that is either temporarily stored in the computer's memory ("session cookie") or stored on the hard drive ("permanent" cookie). Cookies contain, for example, information about previous visits by the user to the respective server or information about which offers were previously accessed. Cookies are not used to run programs or load viruses onto your computer. The main purpose of cookies is to provide a customized offer tailored to the customer and to make the use of the service as convenient as possible.

The data controller uses session cookies as well as permanent cookies.

Session Cookies
The data controller predominantly uses "session cookies" that are not stored on the customer's hard drive and that are deleted when the browser is closed. Session cookies are used for login authentication and load balancing (system load balancing).

Permanent Cookies
In addition, the data controller uses "permanent cookies" to save the personal usage settings that a customer enters when using the data controller's services, allowing for personalization and improvement of the service. Permanent cookies ensure that the customer finds their personal settings again during a repeat visit to the websites of the data controller. Additionally, service providers commissioned by the data controller to analyze user behavior use permanent cookies to recognize repeat users. These services store the data transmitted by the cookie exclusively anonymously. There is no association with the customer's IP address.

Avoiding Cookies
Visitors can refuse the setting of cookies at any time. This is usually done by selecting the appropriate option in the settings of the browser or through additional programs. More detailed information can be found in the help function of the browser used by the customer. If the customer chooses to disable cookies, this may limit the functionality of the service and negatively affect the use of the data controller's services.

WITH WHOM THE PERSONAL DATA IS SHARED

We may share your personal data with any company within the ASMALLWORLD Group, i.e., with our subsidiaries, our ultimate holding company, and its subsidiaries, for outsourcing purposes (i.e., when such a member of our group provides services for and on our behalf).

If you provide ASW Travel AG with information, it will be collected, processed, and maintained solely by us or by our third-party providers, who are bound to our privacy policy or to restrictions that are at least as restrictive as those set out in this policy.

Partners may sponsor special offers, promotions, privileges, or contests where you need to disclose personal data to take advantage of them. We will never share private data, including email addresses, with partners without your prior express consent.

Certain partners may require you to register on the partner's website or agree to terms that authorize us to share your data with the respective partner. We always recommend reviewing our partners' privacy policies before submitting any information about yourself.

We may share your personal data:

In the event that we sell or buy a company or assets, in which case we may share your personal data with the potential seller or buyer of such a company or assets;

If we or substantially all of our assets are acquired by a third party, in which case the personal data stored by us will be one of the transferred assets; and

If we are required to disclose or share your personal data to comply with a legal obligation or to enforce or apply our terms of use and other agreements or to protect our rights, property, or the safety of our customers or others.

Use of Analytical Programs

The data controller conducts or has conducted analyses of the behavior of its customers within the use of its service. For this purpose, anonymized or pseudonymized usage profiles are created. The creation of usage profiles is solely for the purpose of constantly improving the data controller's service.

The data controller also uses Google Analytics within the framework of web analysis, a web analysis service of Google Inc. ("Google"). The data controller uses Google Analytics with the extension "_anonymizeIp()", which means that IP addresses are only processed in shortened form to exclude direct personal references. Data collection and storage in this context can be objected to at any time with effect for the future. Please contact Google directly for this purpose.

Google requires its users, such as the data controller, to use the following notice in their privacy policies. Jetbeds complies with this request by reproducing the following text:

"Google Analytics uses so-called 'cookies', text files that are stored on your computer and that enable an analysis of your use of the website. The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information to evaluate your use of the website, to compile reports on website activity for website operators, and to provide other services related to website usage and internet usage. Google may also transfer this information to third parties if required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser; however, please note that if you do this, you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above."

Use of Google Analytics Remarketing

This website uses the functions of Google Analytics Remarketing in conjunction with the cross-device functions of Google AdWords and Google DoubleClick. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

This function allows the advertising target groups created with Google Analytics Remarketing to be linked to the cross-device functions of Google AdWords and Google DoubleClick. This allows personalized, interest-based advertising messages that have been customized based on your previous usage and browsing behavior on one device (e.g., cell phone) to be displayed on another of your devices (e.g., tablet or PC).

If you have given the appropriate consent, Google will link your web and app browsing history with your Google account for this purpose. This allows the same personalized advertising messages to be displayed on any device you sign in to with your Google account.

To support this function, Google Analytics collects Google-authenticated IDs of users, which are temporarily linked to our Google Analytics data to define and create target groups for cross-device-advertising.

You can permanently opt-out of cross-device remarketing/targeting by disabling personalized advertising in your Google account; follow this link: https://www.google.com/settings/ads/onweb/.

The aggregation of the collected data in your Google account is based solely on your consent, which you can give or withdraw at Google (Art. 6 para. 1 lit. a GDPR). For data collection processes that are not merged in your Google account (e.g., because you do not have a Google account or have objected to the merging), the data collection is based on Art. 6 para. 1 lit. f GDPR. The legitimate interest arises from the website operator's interest in the anonymized analysis of website visitors for advertising purposes.

For further information and the privacy policies, please refer to Google's privacy policy: https://www.google.com/policies/technologies/ads/.

Use of Facebook Social Plugins

The data controller uses social plugins ("plugins") of the social network facebook.com, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"), on its website. The plugins are identified with a Facebook logo. When the customer accesses a website of the data controller that contains such a plugin, the customer's browser establishes a direct connection with Facebook's servers. The content of the plugin is transmitted by Facebook directly to the customer's browser and integrated into the website.

By integrating the plugins, Facebook receives the information that the customer has accessed the corresponding page of the data controller's website. If the customer is logged in to Facebook, Facebook can assign the customer's visit to their Facebook account. If the customer interacts with the plugins, for example, by clicking the "Like" button or leaving a comment, the corresponding information is transmitted from the customer's browser directly to Facebook and stored there. The purpose and scope of the data collection and the further processing and use of the data by Facebook, as well as the relevant rights and settings options for protecting the customer's privacy, can be found in Facebook's privacy policy.

If the customer does not want Facebook to collect data in the manner described above, they must log out of Facebook before visiting the data controller's website.

Use of Twitter

The data controller uses functions of the Twitter service on its website. These functions are offered by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA. By using Twitter and the "Re-Tweet" function, the websites you visit are linked to your Twitter account and made known to other users. Data is also transferred to Twitter. We would like to point out that, as the provider of the site, we have no knowledge of the content of the transmitted data or its use by Twitter. For more information, please refer to Twitter's privacy policy at: www.twitter.com/privacy.

You can change your privacy settings on Twitter in the account settings at www.twitter.com/account/settings.

Use of YouTube Plugins

We use plugins from the provider YouTube for the integration of videos. YouTube is operated by YouTube LLC with its main office at 901 Cherry Avenue, San Bruno, CA 94066, USA. YouTube is represented by Google Inc., located at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

On our website, we use plugins from the provider YouTube. When you visit our website, which is equipped with a YouTube plugin, a connection to the YouTube servers is established. This informs the YouTube server which websites you have visited. If you are logged in as a member of YouTube, YouTube assigns this information to your personal user account. When using the plugin, such as clicking the start button of a video, this information is also assigned to your user account. You can prevent this assignment by logging out of your YouTube user account as well as other user accounts of YouTube LLC and Google Inc. before using our website and deleting the corresponding cookies of these companies.

For more information on data processing and privacy by YouTube (Google), please visit www.google.de/intl/de/policies/privacy/.

Use of Instagram Social Plugins

Our website uses so-called social plugins ("plugins") from Instagram, which is operated by Instagram LLC, 1601 Willow Road, Menlo Park, CA 94025, USA ("Instagram"). The plugins are marked with an Instagram logo, for example, in the form of an "Instagram camera". An overview of the Instagram plugins and their appearance can be found here: http://blog.instagram.com/post/36222022872/introducing-instagram-badges.

When you visit a page of our website that contains such a plugin, your browser establishes a direct connection to Instagram's servers. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. By integrating the plugins, Instagram receives the information that your browser has accessed the corresponding page of our website, even if you do not have an Instagram profile or are not logged in to Instagram. This information (including your IP address) is transmitted by your browser directly to an Instagram server in the USA and stored there.

If you are logged in to Instagram, Instagram can immediately associate your visit to our website with your Instagram account. If you interact with the plugins, for example by pressing the "Instagram" button, this information is also transmitted directly to an Instagram server and stored there. The information is also published on your Instagram account and displayed to your contacts.

For more information on the purpose and scope of data collection and the further processing and use of data by Instagram, as well as your rights and settings options for protecting your privacy, please refer to Instagram's privacy policy: https://help.instagram.com/155833707900388/.

If you do not want Instagram to associate the data collected via our website directly with your Instagram account, you must log out of Instagram before visiting our website. You can also completely prevent the loading of Instagram plugins with add-ons for your browser, e.g., with the script blocker "NoScript" (http://noscript.net/).

Use of MailChimp

This website uses the services of MailChimp for sending newsletters. The provider is Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service that can be used to organize and analyze the sending of newsletters. When you enter data for the purpose of receiving newsletters (e.g., email address), it is stored on the servers of MailChimp in the USA.

MailChimp is certified under the "EU-US Privacy Shield". The "Privacy Shield" is an agreement between the European Union (EU) and the USA to ensure compliance with European data protection standards in the USA.

With the help of MailChimp, we can analyze our newsletter campaigns. When you open an email sent by MailChimp, a file contained in the email (called a web beacon) connects to MailChimp's servers in the USA. This allows us to determine whether a newsletter message was opened and which links were clicked, if any. Technical information is also collected (e.g., time of retrieval, IP address, browser type, and operating system). This information cannot be attributed to the respective newsletter recipient. It is used exclusively for statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipients.

If you do not want MailChimp to analyze your data, you must unsubscribe from the newsletter. We provide a corresponding link in every newsletter message for this purpose. You can also unsubscribe directly from the website.

Data processing is based on your consent (Art. 6 para. 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing already carried out remains unaffected by the revocation.

The data you have stored with us for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of MailChimp after you unsubscribe from the newsletter. Data stored by us for other purposes (e.g., email addresses for the members' area) remain unaffected.

For more details, please refer to MailChimp's privacy policy: https://mailchimp.com/legal/terms/.

Conclusion of a Data Processing Agreement

We have concluded a so-called "Data Processing Agreement" with MailChimp in which we oblige MailChimp to protect the data of our customers and not to pass it on to third parties. This contract can be viewed at the following link: https://mailchimp.com/legal/forms/data-processing-agreement/sample-agreement/.

Use of Affilinet

The data controller has integrated components of the company Affilinet on this website. Affilinet is a German affiliate network that offers affiliate marketing.

Affiliate marketing is an internet-based form of distribution that allows commercial operators of websites, so-called merchants or advertisers, to display advertising, which is usually remunerated via click or sale commissions, on third-party websites, i.e., with distribution partners who are also called affiliates or publishers. The merchant provides advertising material, such as a banner ad or other suitable means of internet advertising, via the affiliate network, which is subsequently integrated by an affiliate on their own internet pages or advertised via other channels such as keyword advertising or email marketing.

The operating company of Affilinet is Affilinet GmbH, Sapporobogen 6-8, 80637 Munich, Germany.

Affilinet sets a cookie on the information technology system of the affected person. What cookies are has already been explained above. The tracking cookie from Affilinet does not store any personal data. Only the identification number of the affiliate, i.e., the partner who refers the potential customer, and the order number of the visitor to a website and the clicked advertising medium are stored. The purpose of storing this data is to process commission payments between a merchant and the affiliate, which are handled via the affiliate network, i.e., Affilinet.

The affected person can prevent the setting of cookies by our website, as described above, at any time by adjusting the settings of the internet browser used, thereby permanently objecting to the setting of cookies. Such a setting of the internet browser used would also prevent Affilinet from setting a cookie on the information technology system of the affected person. In addition, cookies already set by Affilinet can be deleted at any time via an internet browser or other software programs. The applicable data protection provisions of Affilinet can be accessed at https://www.affili.net/de/footeritem/datenschutz.

Use of Zendesk

The data controller uses the ticket system Zendesk, a customer service platform of Zendesk Inc., 989 Market Street #300, San Francisco, CA 94102, for handling customer inquiries. For this purpose, the necessary data for the request is collected and processed via our website.

Jetbeds uses the chat service of the company Zendesk (zendesk.com) for the live chat offered. Data is transmitted there, which serves to document customer service. The collected data includes: chat history, provided name, IP address, country of origin, and other personal information depending on the provided details. This data is not passed on to third parties and is only used for handling and documenting inquiries. By using the chat, you agree to this. Further information on the chat and the data protection provisions of Zendesk can be found here.

Zendesk is certified under the "EU-US Privacy Shield". The "Privacy Shield" is an agreement between the European Union (EU) and the USA to ensure compliance with European data protection standards in the USA.

Further information on data processing by Zendesk can be found in Zendesk's privacy policy. If you have any questions, you can also contact Zendesk's data protection officer directly at: privacy@zendesk.com.

Use of Google Web Fonts

This site uses so-called web fonts provided by Google for the uniform display of fonts. When you call up a page, your browser loads the required web fonts into your browser cache to display texts and fonts correctly. For this purpose, the browser you use must connect to Google's servers. This informs Google that your IP address has accessed our website. The use of Google Web Fonts is in the interest of a uniform and appealing presentation of our online offers. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. If your browser does not support web fonts, a standard font from your computer will be used. Further information about Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://www.google.com/policies/privacy/.

You may opt-out of receiving communications from us and/or our partners, as well as participating in member surveys, at any time by either following the simple opt-out procedure described in each email or by sending us an email at privacy@asw.com.

Please note that in certain rare cases, we may send emails to deliver important corporate or membership messages, such as changes to our privacy policy or confirmation of your membership payment. These emails do not have an opt-out function as they are one-time communications. To ensure that you are removed from the lists, please provide us with your exact name and email address that you provided in your original communication with us.

WHERE WE STORE/TRANSFER YOUR PERSONAL DATA

Our main servers for registered users and members are located in Switzerland. However, the data we collect from you may be transferred to, stored, and processed at a location outside of Switzerland and the European Economic Area ("EEA"). The data may also be processed by staff operating outside of Switzerland and the EEA who work for us or our suppliers, including in countries such as the United Kingdom and the United States of America.

By consenting to the collection and processing of your personal data, you agree to such transfer, storage, or processing. We will take all reasonable steps to ensure that your personal data is treated securely and in accordance with this privacy policy.

The transfer, storage, or processing of personal data outside of Switzerland and the EEA does not restrict your rights, and we will take all reasonable steps to ensure that all data transferred, stored, or processed outside of Switzerland and the EEA is treated securely in accordance with this privacy policy and with the same level of protection required by the Swiss Federal Data Protection Act ("DSG").

DATA RETENTION POLICY

If you unsubscribe from ASW Travel AG's services, we may retain information you have provided or information collected from you for backup, archival, and/or audit purposes to prevent fraud or other criminal activity, as well as for the period required by applicable law.

We will delete personal data from our database when we are legally required to do so. We will also delete personal data at your request in accordance with the "right to be forgotten" under Art. 17 GDPR and similar local and national regulations in other countries.

In accordance with Art. 16 GDPR (and similar local and national regulations in other countries), we will also correct inaccurate personal data about you if you so request (for both, please send your request by email to privacy@asw.com).

We regularly review how we collect, store, and process information, including the physical security measures to protect our systems from unauthorized access.

All our services are fully encrypted with SSL, and access to personal data is restricted to employees, contractors, and representatives of ASW Travel AG, to the extent relevant to their tasks (e.g., processing specific information). Anyone who has access to private data is bound by strict confidentiality rules.

ACCESS TO INFORMATION

DSG, GDPR, and other local and national regulations give you the right to access the personal data stored about you. Your right of access may be exercised in accordance with these laws, subject to any fees ASW Travel AG may charge you under these laws (please send an email request to privacy@asw.com).

NOTIFICATION OF NEW PURPOSES

Occasionally, we may use personal data for new, unforeseen purposes not previously mentioned in this privacy and cookie policy. In such cases, we will notify you by email of the content and purpose of the change.

If you do not object in writing (by email to privacy@asw.com) to such a change within ten (10) days of the date of the email, the changes will be deemed accepted by you. All changes to data collection will take effect from that point forward. We will not collect data retroactively for new collection procedures.

In the event of any discrepancies or differences in interpretation between the English translation and the original German version, the German version shall prevail and govern.
